What Recall Florida is About!
Recall Florida is a nonpartisan citizen activist group dedicated to empowering Florida citizens to advocate for change by instructing and directing them to lobby their representatives. Our mission stems from a recognition of the existing inequity in Florida law, which grants charter counties and residents of municipalities the right to recall corrupt county officials under F.S. 100.361, while denying this right to non-charter counties.
We firmly believe that the recall petition is not just a privilege but a constitutional right. Both the Florida and Federal Constitutions uphold citizens’ rights to assemble, instruct their representatives, and petition for the redress of grievances. Therefore, we view the prohibition against non-charter counties from recalling county officials as a violation of fundamental constitutional principles, including the 14th Amendment’s guarantee of equal protection under the law.
Article 1 Section 5. Right to assemble. —The people shall have the right peaceably to assemble, to instruct their representatives, and to petition for redress of grievances. as well as a First Amendment right according to our Federal Constitution:
Amendment I: Congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
Because FS 100.361 prohibits non charter counties from recalling county officials. We believe that this Florida law violates our Federal Constitution’s:
14th Amendment: All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of equal protection of the law…
Elected office is a position of public trust, and when officials betray that trust through acts of malfeasance or misfeasance, the people must have the means to hold them accountable. Waiting until the next election can result in further harm to public systems and undermine the welfare of the community. We are committed to creating a better Florida by advocating for a rigorous and orderly process for the removal of corrupt county officials.
We invite all concerned citizens to join us in the Recall Florida movement. Together, by contributing our time, talents, and resources, we can influence the legislature to pass a bill granting citizens the power to remove corrupt officials. This constitutional amendment requires a 3/5 vote in both Houses to be placed on the 2026 ballot and 60% of all participating Florida voters to vote “YES” for it to become law.
